Terms of Service

1. Acceptance & eligibility

These Terms of Service ("Terms") govern your access to and use of archivooo (the "Service"), operated by archivooo ("we", "us", "our"). By creating an account, browsing the archive, uploading images, or purchasing a license, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

2. Definitions

• Photographer — a user who owns the copyright in film photographs and offers them for licensing through the Service.
• Lab — a film-processing partner that may upload and manage scans on behalf of a Photographer, with that Photographer's authorisation.
• Buyer — a user who purchases a license to use an image.
• Content — images, scans, metadata, text, and other material uploaded to the Service.
• Preview — the watermarked, resolution-limited version of an image displayed publicly in the archive.
• Original — the full-resolution file delivered to a Buyer on a valid license purchase.
• License — the specific permission to use an image, on the terms presented at checkout.

3. Accounts

To upload or purchase you must register for an account and provide accurate, current information. You are responsible for keeping your credentials confidential and for all activity under your account, and you agree to notify us promptly of any unauthorised use.

Each account is assigned a role — Photographer, Lab, Buyer, or administrator — which determines the features available to it. We may suspend or close an account that violates these Terms, or that we reasonably believe poses a risk to the Service or to other users.

4. Photographer & lab content

Photographers retain all copyright and ownership in their images. By publishing an image, the Photographer (or a Lab acting on the Photographer's behalf) grants archivooo a worldwide, non-exclusive, royalty-free license to store, reproduce, display, and distribute watermarked Previews for the purpose of operating and promoting the Service, and to deliver Originals to Buyers who purchase a License.

You represent and warrant that: you own or control all rights in the Content you upload; you have obtained any releases or permissions needed from identifiable people and from the rights-holders of identifiable property or trademarks shown; and the Content does not infringe any third party's rights. Labs may upload only Content they have been authorised by the relevant Photographer to upload, and are responsible for correct attribution. You are responsible for the accuracy of the metadata you provide.

5. Licenses to buyers

Each image is licensed to Buyers under the specific scope, terms, and price presented at checkout, which become part of these Terms at the moment of purchase. A snapshot of the license text in force at the time of sale is recorded with each order and governs that purchase.

Unless the applicable license expressly states otherwise, licenses are non-exclusive and non-transferable, grant rights only to the named Buyer, and may not be sub-licensed, resold, or redistributed. You may not use an image beyond the scope of the License you purchased, remove attribution where the License requires it, or use an image in a way that is unlawful, defamatory, or that falsely implies endorsement by any person depicted. Downloading, copying, or using any image without a valid License is prohibited.

6. Payments, fees & payouts

Prices are shown in the currency indicated at checkout and may exclude applicable taxes, which are added where required. Payments are processed by our third-party payment provider; by purchasing you also agree to that provider's terms. We do not store full payment-card details.

Revenue from each sale is split between the Photographer, the contributing Lab, and archivooo according to the rates in effect at the time of sale; the split applied to each order is recorded with that order. Payouts to Photographers and Labs are made through the payment provider's connected-account system and are subject to successful onboarding, identity and tax verification, any minimum threshold, and the provider's payout schedule. You are responsible for the accuracy of your payout details and for any taxes due on amounts you receive.

7. Refunds

Originals are digital goods delivered immediately on purchase. To the extent permitted by law, completed License purchases are final and non-refundable once the Original has been made available for download. Where you are a consumer with a statutory right of withdrawal, you acknowledge that by completing a purchase and accessing the Original you request immediate performance and, where the law allows, waive that right.

If a file is faulty, materially not as described, or you were charged in error, contact us and we will work with you to put it right — including issuing a refund where appropriate or required by law.

8. Image availability, removal & retention

Photographers control whether their images are published to the public archive and may unpublish them at any time. An unpublished image is removed from public view but may be retained in our storage, and images that remain unpublished may be retired from a Photographer's library after a period of inactivity.

When an image is deleted or retired it is removed from public display; however, we may retain the Original in storage so that Buyers who have already purchased a License can continue to access the file they licensed, and so that we can meet our legal, accounting, and record-keeping obligations. archivooo may, at its discretion, unpublish, remove, or permanently delete any Content that does not meet the archive's editorial standards or that violates these Terms. Permanent deletion of an image that has already been sold may be limited in order to preserve existing Buyers' rights and order records.

9. Acceptable use

You agree not to: access the Service other than through the interfaces we provide; scrape, harvest, or bulk-download Content; hotlink, embed, or reproduce Previews or Originals outside the Service except as a License permits; circumvent or attempt to circumvent watermarking, access controls, or other protective measures; probe, scan, or test the vulnerability of the Service or breach its security; or upload malware or otherwise infringe the rights of others.

Previews are provided for browsing within the Service only. The fact that a Preview is technically viewable does not grant any right to download, copy, or use it.

10. Prohibited content

You must not upload or transmit Content that is unlawful, infringing, defamatory, obscene, or hateful; that depicts or facilitates the abuse or exploitation of any person; or that violates the privacy, publicity, or intellectual-property rights of others. We may remove such Content and suspend or terminate the responsible account. Repeated or serious violations result in account termination and, where appropriate, referral to the relevant authorities.

11. Intellectual property in the Service

The archivooo name, logo, design, software, and the selection and arrangement of the archive are owned by archivooo and protected by intellectual-property laws. Except for the rights expressly granted to you under a License, nothing in these Terms transfers any right in the Service or its underlying technology to you.

12. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. Please review it to understand what we collect and how we use it.

13. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, and uninterrupted or error-free operation. We do not warrant that any image, metadata, or attribution is accurate or complete, or that the Service will meet your requirements. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

14. Limitation of liability

To the maximum extent permitted by law, archivooo and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of the amounts you paid to us in the twelve months before the event giving rise to the claim, or fifty euros (€50). Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless archivooo and its operators from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising from the Content you upload, your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

16. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination — including ownership, licenses already granted to Buyers, payment obligations, disclaimers, limitations of liability, and indemnification — survive. Licenses validly purchased by Buyers before termination remain in effect under their original terms.

17. Governing law & disputes

These Terms are governed by the laws of Spain, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there — except where mandatory consumer-protection law gives you the right to bring proceedings where you live. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.

18. Changes to these terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
